Reader’s Question:

Can you tell me the law in Georgia regarding SR22?

Mike

Atlanta GA

In the US alone, different states have various laws and regulations with regards to Driving under the Influence or DUI. In Georgia car insurance law, it is unlawful to have a vehicle without car insurance coverage. Permitting an individual without insurance operate a vehicle is likewise illegal.

In Georgia car insurance law, the minimum required liability coverage is as follows:

1. $25,000.00 for bodily injury liability per person per accident-

2. $50,000.00 . for bodily injury liability for two or more persons per accident

3.  $25,000.00 for property damage per accident

The law enforcement officer will request the driver to show proof of mandatory liability insurance. IDs or papers from the insurer have to be presented.

If the insurance has lapsed at the time of the accident, the Georgia Department of Motor Vehicles will suspend the your drivers license until insurance policy has been renewed.

If you have been convicted of DUI, you will be required to get a special kind of car insurance called SR 22. This SR22 is a certificate that shows proof proof of financial responsibility of the driver. It’s an assurance that the driver will keep the minimum liability insurance coverage required by the state.

Georgia SR22 Auto Insurance Tips For Lower Rates

As I addressed in the previous post, an SR22 form is something that needs to be filed by your auto insurance company with the Georgia Department of Motor Vehicles after you have committed a drunk driving offense or some other offense that ends you with a suspended license. Now that you know what  insurance SR22 filing is, though, how do you go about getting it? It might be a little difficult for you, but it can be rather easily explained.

  • Contact.

Get your insurance company on the line and talk with your agent. Tell them you have a suspended license and inquire if they can help you with getting an SR22 form set up so that you can restore your driving privileges.

This is where you might run into some hang ups. Just because you need SR22 insurance, doesn’t mean that your insurance company is going to provide you with it. You may find your renewal of insurance denied if you are at the end of your six month period, or you’ll see your insurance policy outright canceled. Unfortunately, if it’s going to happen you can’t avoid it, but you can start looking at other Georgia auto insurance companies and set yourself up with a new company.

  • Get a new quote.

Once you are required to file SR22 insurance with your  insurance company, you are no longer the same customer as before. Now that you are part of a higher risk group, you will need a new quote appropriate to your rating, and that is only if your Duluth GA automotive insurance company decides to keep you on board.

You have the best chance at getting a good rate and staying with your insurance company if you had a good track record with them in the first place. Many preferred and long time customers get DUI convictions and don’t see their insurance rates go up even a dollar.

  • Decide on your coverage.

As when you get any car insurance policy, you will need to choose your coverage. Collision will be through the roof if you have to file SR22, so avoid it unless you’re still purchasing your car and thus have no choice.

insurance law only requires that you get the minimum liability coverage for your SR22 policy, so unless you have no other option, I suggest you go with that. SR22 filing.

Once you have made your down payment or paid your first premium bill, you will need to get your SR22 form. Your insurance company will provide you with this, and every one has its own way. With some, you’ll be able to access it online, and with others you’ll have to wait for it in the mail. Once it arrives, fill it out and turn it in to the DMV.

SR22 Insurance In Georgia – Auto Insurance After DUI

This is an excellent and informative video that gives an introduction to Georgia SR22 car insurance, and also explains how to get non owners insurance with your SR22 form. The SR22 is the type of car insurance that we are all avoiding, but due to police forces in Georgia cracking down on speeders and drunk drivers, more and more people are filing SR22 forms every year. When you are convicted for driving under the influence while in Georgia, your license is suspended. In order to get it back, you’re going to have to get a special type of car insurance, which is called SR22 insurance. SR22 car insurance is basically a type of insurance that is filed with the department of motor vehicles every month so that they remain informed as to your status, and can be alerted when you lapse in your car insurance coverage.

While DUI is the most common offense that requires a license suspension and this SR22 car insurance, it is necessary almost anytime you get your license instated after a suspension. You can have your license suspended for committing several traffic violations and for speeding, among other things. When you reinstate your license, you will be required to file Georgia SR22 car insurance for three years. However, the clock starts ticking when your license is suspended, so if you don’t reinstate your license until three years after it was suspended (perhaps you’ve decided that SR22 car insurance is too expensive and you can survive taking the bus) then you will never have to file SR22 car insurance.

    • Misery needs a good company.

When you file your SR22 car insurance, you have to do so with a company that is licensed by the Department of insurance, just as with any other type of car insurance. If you want to avoid any problems with your SR22 filing, make sure that all of your information matches, from your vehicle registration to your driver’s license to your car insurance policy to your SR22 form.

    • Can’t say no.

Until your period of filing SR22 is finished, you can’t file an SR26, which would cancel it. Your insurance has to cover you for the whole time, or you could be in hot water. This does not in any way mean that you can’t change companies while you’re filing SR22 car insurance–on the contrary, it’s even more important to get a good car insurance quote while you’re part of such a high risk group. However, you need to ensure that there is no lapse in your car insurance coverage, however short.

    • What you need.

Your SR22 car insurance coverage is only required to have the same minimum liability as any other car insurance policy. However, you might want to consider adding comprehensive and collision coverage if you have a newer car. If you want to keep your SR22 car insurance coverage as cheap as possible, though, cut your coverage to the least you need to get.

Can I Get a Copy Of My Driving Record In Georgia?

    Reader’s question:

Can I get a copy of my Georgia driving record if I go to the local Georgia Department of Motor Vehicles? Will they be able to get my traffic tickets from my previous residence from a different state 2 years ago?

    Matt

    Good question.

The Georgia DMV does not allow you to obtain a copy of your driving record. But you may be able to download a non certified copy of your driving record through the DDS website or you may go to the DDS customer service center.

You will be needing your driver’s license number, a date and birth and a password where you can request online before you can download the information you need. There is also a fee that you will need to pay. It is $5 for 3 year record and $7 for a 7 year record. Remember that it is only a non certified copy of your driving history.

Your Georgia driving record can also be purchased in person at the DDS customer service center with proper identification. You also have the option to send a request through mail. You will need to submit a notarized letter requesting either the 3 or 7 years of your driving history and provide other information so the DDS can process your request.

You can call DDS to get more information if you want to use this option.

    Goodluck!

    Reader’s question:

Hi! I just want to know what an SR22A is. Thank you.

    Michelle

    Thank you for asking Michelle.

The Sr22A is a term used by the state of Georgia for a GA Responsibility Insurance certificate which is similar to SR22 except that it has further restrictions. In Georgia, this financial responsibility filing is required for motorist that has been convicted operating a vehicle without liability insurance.

SR22A is also sometimes called as the Financial Responsibility. Under title 40 of the official Code of Georgia Annotated shows the reason why an individual needs to maintain an SR22A.The individual’s amount of time to carry this depends on certain reasons .Usually it is required from between one to three years.

If you are for example trying to reinstate you license in Georgia after suspension due to subsequent conviction of no proof of insurance,an sr22a must be maintained for 3 years from the date of the conviction.

An insurance company must certify that you have a valid liability insurance. This certification will be filed on the sr-22a form. If you have been notified by the Department of Motor Vehicles that you must carry an SR-22a filing, this should be certified by the insurance company to show proof that you have insurance and meet the financial responsibility requirement in the state of Georgia. However if you are going to cancel the policy before the date the state has given you to carry the sr22a, the insurance company will notify the DMV that the policy has been cancelled and that you no longer have the required insurance.

    Goodluck!
